Revoking your Will due to life changes

Life doesn’t always go to plan, and your Will should be changed to reflect this. There are several situations which may result in you wanting your Will to be revoked: an important life event or a rethink of your financial situation.

If you don’t rewrite your Will after a change of heart, situation or relationship, several problems could arise. Quite obviously, your estate may pass into the hands of people other than the ones you now want it to go to.  New partners, children or beneficiaries may not be provided for, and those named as executors may no longer be the people you would want to oversee the court’s handling of your estate in the event of your death.

It’s really quite simple to write an entirely new document, and the first line of any Will should state that all previous such documents are revoked by the creation of this one. As a result, your latest Will is always the one that will be legally valid.

Just to be sure there won’t be any confusion, you should try to ensure that every copy of any previous will is destroyed. This may mean retrieving copies of former Wills from places such as a solicitor’s office or the UK
Will Register. We can help you with this, giving you the benefit of our professional expertise to ensure that your new Will is the only one which will be taken into account in the event of your death.

You can make a new Will at any point in your life. You don’t have to wait for life changing situations such as marriage, divorce, separation or the birth of children (although these events should certainly lead to the creation of a new Will). Any change of financial situation, rethink of your future or change of heart is a perfectly good reason to get your Will
rewritten. It’s the only way to ensure that your wishes would be carried out exactly as you’d want them to be.
